These Terms are governed by Illinois law. All legal matters will be resolved in Will County, Illinois.

Dispute Resolution

Limitation of Legal Remedies

You agree to arbitrate any claims individually, not as part of a class action. Arbitration will occur under AAA rules. For claims under $10,000, Magic Fresh will pay arbitration costs, offer phone arbitration, and waive attorney’s fees.

Arbitration Procedures

To initiate arbitration, send a written notice describing the claim to Magic Fresh, LLC, 354 Daffodil Dr., Romeoville, IL 60446. We’ll have 60 days to resolve the claim before arbitration begins. Arbitration will take place in Tennessee under AAA rules.

Choice of Law

This agreement is governed by the Federal Arbitration Act, not state law.

Exception

Claims for indemnification, injunctive relief, or interpleader are not subject to arbitration.

Additional Terms

Failure to enforce any part of these Terms does not waive that right. These Terms can be assigned by us without notice. If any part is deemed invalid, the rest remains in effect. All rights not expressly granted are reserved.
